I am surprised that the royalty doesn't go back to the initial date of the patent infringement rather than the date of the issuence of the ruling. This is as interesting as Gambro having to pay DaVita for every delivery system they purchased from Fresenius during the FDA ban on the Phoenix system. Life is curious.

Lets wait to see what happens in the Ninth Circuit Court of Appeals, remember the US Patent Office ruled that there was no patent infringement and they are a Federal Agency. There are 10 other Circuit Courts as well to move for a change in venue if Fresenius looses the appeal.

I forgot to mention,Even if the Appelate Court refuses to overturn this latest judgement and a change in venue is denied. This is ultimatelly about money and Fresenius will pay whatever it takes to continue buisness as usual. Besides what does Baxter need it for as far as Dialysis is concerned.
